协商民主视角下农村环境纠纷解决的路径探析——以沟通调解为例

Analysis of Paths to Resolve Rural Environmental Disputes in Perspective of Deliberative Democracy:A Case of Communication Settlement

污染企业所在地利益主体间的沟通质量差,是影响污染企业与周边居民纠纷解决效果的重要原因。从协商民主视角探讨农村环境纠纷的解决路径,发现沟通调解方式的现实困境有:困窘的信息编码、低效的沟通渠道以及断裂的客体反馈。为此,要从村民、污染企业和地方政府三方面增强沟通效果。首先,提高村民维权能力和自身素养,要保持内部行动的一致性和凝聚力、增强村维权社会资本、改善农村精英断层局面;其次,督促污染企业承担相应社会责任,要取消行政化地位、改变以钱求和的片面观念、弱化道德优势;最后,摆正地方政府的第三方职能,要主动公开环境污染及赔偿信息、促进村民参与利益决策、理性对待村民维权行为。

Poor quality of communication affected the effects of dispute resolution caused by polluting enterprises. Explored the way to solve rural environmental disputes from the perspective of deliberative democracy,found that the way of communication settlement existed realistic predicament,including embarrassment information coding,inefficient communication channels and faulted feedback. Therefore,which must turn to villagers,polluting enterprises and local government to improve communication effect. Firstly,improving the ability of the villagers＇ rights and their own accomplishment,strengthen the village social capital,improve rural elite fault situation. Secondly,supervising the pollution enterprise to bear the social responsibility,cancel the security administration position,change the one-sided views in sum of money,weakening of moral superiority. Thirdly,regulating local government functions,take the initiative to disclosure environment pollution and compensation information,and promote the villagers to participate in decision-making,rational treatment of villagers＇ rights interest.
