刑法学之外的犯罪学属性界分

The Nature of Criminology Outside the Criminal Law Views

传统犯罪学在我国一直处于刑法学的附属地位。在学科属性上,犯罪学被视为刑法学的下属分支学科;在研究对象属性上,犯罪学的"犯罪"被认定为刑法学的"犯罪"。但是,犯罪学远远超越刑法学所确立的范畴或刑法学无法完全涵盖犯罪学的全部内容,二者并非包容关系。从本质上来说,犯罪学有其自身的属性,即犯罪学在学科属性上是一门社会科学而非法学,其研究对象是犯罪社会现象而非犯罪法律规范。因此,在刑法学之外作出犯罪学本身的属性界分有其特定的恰切性。

The traditional criminology has been in a subordinate position in our country＇s criminal law.On the subject property,criminology is regarded as a subsidiary branch of criminal law.On the research object property,criminology＇s crime was identified criminal for the Criminal Law.However,criminology far beyond the scope of criminal law or criminal law as a established science cannot fully cover the entire contents of criminology;they are not inclusive relationship.In essence,criminology has its own attributes,namely on the subject property criminology is a social science,not a law,and the research object is the social phenomenon of crime rather than crime laws and regulations.Therefore,making criminology own property outside the criminal law sub-sector has its specific nature.
