Analysis of Non-traditional Security Crime

非传统安全犯罪包含两部分,有的非传统安全问题直接表现为一种犯罪行为,例如毒品走私、贩运人口、海盗、跨国洗钱、恐怖主义等;另有一些非传统安全与犯罪有一定联系,可以称之为"涉非传统安全犯罪",但它们不能等同于非传统安全犯罪,必须借助于合理的机制和程序对其进行甄别和筛选。非传统安全犯罪有相较于一般犯罪的特别之处。研究非传统安全犯罪必然对治理这些犯罪的刑事政策产生一定的影响,反过来也会影响安全法治化的实现。

The non-traditional security crime includes two parts, one of them is that some non-traditional security issues directly show as a kind of crime such as drug trafficking, human trafficking, piracy, transnational money laundering, terrorism etc. the other issues are connected with crimes called ＂crimes involved in non-traditional security＂, but they can not be equated with non-traditional security crimes, and they must be screened by reasonable mechanisms and procedures. The non-traditional security crimes are different from general crimes. The study of non-traditional security crimes is inevitable to have an impact on the criminal policy of punishing these crimes, and in turn influences the implementation of security legalization as well.
