论高校学生违纪处分正当程序之重构

A STUDY ON THE?RECONSTRUCTION OF UNIVERSITY STUDENTS′ DISCIPLINARY DUE PROCESS

依法治国是实现我国国家治理现代化的实质性步骤,它是一种整体性、系统性的治国理政方式。通过阐述重构违纪学生处分正当程序对维护学生正当权利、防止权力滥用等方面的意义,进而分析了当下违纪学生处分正当程序存在的问题,从程序的规范、公正与保障三方面提出了具体的实施意见。这对切实维护学生的合法权益、防止权力滥用将产生积极的进步作用。

Ruling the state by law is the substantive step for the realization of governing the state in a modernized way. It is acomprehensive and systematic way for ruling the state. By expounding on the significance of restructuring the due process ofpunishment of breaking-rules students, this paper analyzes the drawbacks of the present due process of punishment of break-ing-rules university students. It also provides specific suggestions in the aspects of norm, justice and guarantee of the process.It will take progressive functions for safeguarding the students＇ legitimate rights and prevent abuses of power.
