大数据法律:国家治理能力现代化的“关键一招”

Big Data Law: the Key of Modernization of the National Governance Capacity

大数据法律是大数据技术和法律实践的有机结合。它以法治思维为灵魂,以法律体系为主干,以法律实践为基础,从大数据技术和法律实践中获得新的元素和发展动力。大数据法律催生了立法新形态,深化和拓展了法学研究,为法律运用提供了便利,也促进了法律服务的转型升级。本文认为应当以充分的数据准备、精准的数据挖掘、有效的数据推送和明确的数据禁区,推动大数据法律服务于法治中国建设和国家治理能力现代化。

The big data law is the organic combination of the big data technology and the law practice. It takes legal thinking as the soul, legal system as the stem, and legal practice as the foundation. It obtains new elements and impetus from the big data technology and the law practice. Besides the big data law not only has given rise to new forms of legislation, and deepened and expanded the study of law for providing convenience for legal application, but also promote the transformation and upgrading of the legal services. Therefore, this paper holds that we should use sufficient data preparation, accurate data mining, effective data push and clear data prohibition to promote the rule of law construction of China and modernization of the national governance capacity.
