对建立我国新型网络实名制的思考——以韩国网络实名制的兴衰为视角

Thinking on Establishing New Network Real Name System in China-from the Perspective of the Rise and Fall of the Real Name Network System of Korean

韩国是亚洲乃至世界互联网产业发展最为迅速、技术最为先进的国家之一,同时也是世界上第一个正式推行网络实名制的国家。虽然韩国网络实名制并没有达到预期目的,但它给世界各国带来了不少经验、教训与启示。我国网络实名制起步较晚,相应立法比较落后,韩国网络实名制可以作为我国建立网络实名制的一个重要参考。借鉴韩国网络实名制的经验教训,我国在建立新型网络实名制时,应注重从我国实际情况出发,完善网络实名制立法,以达到有效保护个人信息的目的。

Korea has the fastest and most technically advanced internet industry among the Asian countries,even worldwide. Meanwhile Korea is also the first country that adopts the real-name system for internet access.Although the system has not reached its expectation, it provides plenty of experiences, lessons and insights. Our country＇s real-name system for internet access started much later than Korea, resulting underdeveloped legislation.Korean real-name system for internet access will be an important reference and guidelines for us. By studying success and failures of the Korean, China should implement the system based on national conditions and improve the legislation to ensure personal information protection.
