关于警务用枪法律规定的若干思考

Some Thoughts on Laws and Regulations of Firearms Use by Police

为了使公安机关能够更好地履行维护社会稳定、惩治犯罪分子的职责,《中华人民共和国枪支管理法》规定人民警察依法享有配枪的权利,并指出当出现紧急情况时人民警察可以使用配枪。但是在现实的公安工作中,我们看到更多的却是民警用枪时的迷茫与困境:主要表现为很多民警不愿意佩戴枪支或者是在发生紧急情况时不会或不敢开枪。这其中有制度的缺失,有法律法规的影响,有民警自身的因素甚至包括整个社会大环境的作用。本文试图从其一点,即从法律规范的角度对当前公安机关警务用枪的现状展开探讨,为今后的立法工作提供有益借鉴。

In order to make the public security organ better to perform the duties of maintaining social stability and punishing the criminal, Law of the People’s Republic of China on Control of Guns provides that the police have the right to match the guns in accordance with the law and points out that when there’s an emergency, the police can use guns. However, in the reality of the public security work, we see more of the confusion and difficulties when the police use guns. The main performance is that lots of police are unwilling to wear firearms or cannot or even don’t dare to shoot. This phenomenon can be attributed to the lack of system, the influence of the laws and regulations, the police itself and even the function of the whole social environment. This article attempts from one point, the angle of legal norms to discuss about the present situation of the using of firearms in public security organization, and to provide salutary references for the future legislative work.
