从社会情境分析到扩展案例分析--格拉克曼法律人类学方法论思想研究 被引量:10

From the Social Situation Analysis to the Extended-Case Analysis:Max Gluckman's Methodology of Legal Anthropology

摘要 早期西方法律人类学有关案例分析法的描述与阐释具有明显的知识论缺陷。格拉克曼提倡的扩展案例分析法,克服了传统案例分析法的诸多缺陷。扩展案例分析法强调对案例做扩展情境分析,其渊源可追溯至格拉克曼早年提出的社会情境分析法。由社会情境分析转向扩展案例分析,意味着格拉克曼法律人类学方法论思想的逐步完善。晚年格拉克曼开始对扩展案例分析法自身的局限性进行反思。无论是创设社会情境分析法,还是将其发展为扩展案例分析法,格拉克曼都想去证明部落社会的法律文明与现代工业社会的法律文明之间不存在本质差异。 The case method of early western legal anthropology had some obvious defects,and it was remedied by the extended-case method which was proposed by Max Gluckman.The extended-case method focused on the case's extended situation analysis,and its origin could be traced to the social situation analysis,which was first promoted in Max Gluckman's ' bridge paper' in 1940.Max Gluckman's methodology of legal anthropology was marked by his transformation from the social situation analysis to the extended-case analysis.However,in Max Gluckman's later years,he began to rethink profoundly the limitations of the extended-case method.Whether in the social situation analysis or in the extended-case analysis,Max Gluckman's aim was to prove that the legal civilization of tribal society did not differ from that of western society.
