论刑事案件庭前会议制度的实践争议及立法重构

刑事案件庭前会议制度是我国完善刑事诉讼制度的重要举措,该制度在实施中存在较多盲区和争议。刑事案件庭前会议制度在司法适用的过程中还存在诸多难题与困惑,比如基于重实体轻程序传统观念的影响导致庭前会议在刑事司法实践中适用率低下,庭前会议的适用范围原则性不强、随意性较大,庭前会议的具体内容不明确,庭前会议有谁启动、具体启动程序如何,以及庭前会议的法律效力如何等问题。通过改变传统观念、重视庭前会议的适用、提高适用率,将庭前会议相关制度和具体实施问题通过立法或司法解释的方式进一步具体化,使其在刑事审判实践中发挥更大的价值作用。
