Industrial Structure of Chinese Medical Industry and Intellectual Property Protection

在西方,知识产权对医药企业至关重要,医药企业一向是加强知识产权保护的主要推动者,同时亦是专利诉讼的常客。但中国医药企业对知识产权的重视程度及其知识产权保护行为却与西方医药企业相距甚大,这与中国医药产业的特定产业结构与政策因素相关。我国在制定知识产权相关政策的同时,不应忽略使其实际发挥作用的产业环境与土壤;若想提高社会与企业的知识产权保护意识,也必须要考虑到具体产业结构的影响和相关政策的配套调整。

In the West, medcial firms are always the most active promoters ofstronger Intellectual Property protections, and are also active litigants. But in China,the case is quite different, either in the importance of Intellectual Property for firms,or in firms’ protection behaviors. The explaination for this has to do with the specificindustrial structure of Chinese medical industry, as well as the policy background.When Intellectual Property policies are made, the exact industrial environmentwhere it will take effect should not be neglected; if we want to increase the society’sawareness of Intellectual Property Protections, we also have to consider these factorsand make related adjustments.
