摘要
现行"物权性"理论存在界定不清、僵化以及解释力弱的弊病。应厘清和革新现有理论,在重新界定"物权性"的基础上,以动态"物权性"理论为物权体系,乃至物权体系与债权体系之间的"物权性"问题提供一个妥适的整体解决方案,包括两个方面:一是以"物权性"的强弱、虚实论为物权体系的正当性提供支撑;二是以"物权性"的流动论为体系间的交叉重叠提供支撑。只有在动态"物权性"理论的整体框架之下,地役权的"物权性"问题才能得到根本解决。
The Dinglishkeit( special nature of property right) theory in operation is suffering from false definition,inflexibility and weak explanatory power. It is time for us to clarify,and innovate it with dynamic Dinglishkeit theory on the basis of redefinition of Dinglishkeit. By dynamic Dinglishkeit theory we could provide an appropriate integral program for Dinglishkeit problem existing in property right system and between property right and credit right. The program include two important subjects:first,the strength and Xu Shi theory,which can sustain the justifiability of the system of property right; second, the liquidity theory, which will provide a reasonable interpretation for the movement of Dinglishkeit from property right to credit right. Only under the integral theoretical frame of dynamic Dinglishkeit,the problem of Dinglishkeit of easement can be resolved.
