论澳门部分居民国籍争议的法律规制及影响

On the Legal Regulation and Influence of the Debate on the Nationality Issue of Some Citizens in Macao

澳门部分中国居民因可兼具使用葡萄牙旅行证件而存在事实上的双重国籍争议,产生于中葡两国国籍法在澳门适用的事实结果。中葡联合声明签署时双方备忘录和全国人大常委会专项决定所作的制度安排,达致了顺利实现国家对澳门的主权治理的功效,但也遗留了需进一步解决的问题,有必要在坚持既定立场的基础上加以巩固和完善。

Some Chinese citizens in Macao in possession of traveling credentials of Portugal leading to double nationality gives rise to some debate and it is a factual result in the application of both Chinese and Portuguese nationality law in Macao. When the Joint Declaration of the Government of Portugal and the Government of China is signed, the memo and systematic arrangement of the special decision made by the Standing Committee of the National People＇s Congress smoothes the realization of the sovereignty of China over Macao, but leaves some issues unsolved. It is necessary to consolidate and perfect them based on the established position.
