摘要
本文以干部档案管理为例,从人事档案形成的来源内容、整理过程、法律总则三个层面梳理现今法制的不协调现状,分析了我国现今人事档案管理中本人无阅档权规定的不合理性。得出应修订《干部档案工作条例》中"任何个人不得查阅或借用本人的档案"的规定,以实现本人阅档权的结论。
The article takes cadre personnel flies management as an example to analyzes the irrational- ity of the provision which stipulates that no one can access own personnel files from the the aspect of in- stitution. This article also combs the disharmony of the Legal system from the dimensions of source content, organizing process and the general principles of law. Finally, the article concludes that we should amend the provision in order to achieve the accessing right to own personnel files.
