Property Protection on Operator's Information

大数据时代,经营者信息已成为一种独立于物和智力成果的新型财产。法律需要对经营者信息进行赋权保护,构建经营者信息权。经营者信息权本质上为绝对权,权利人享有排除妨害请求权、消除危险请求权、信息恢复请求权和信息删除请求权,以维护经营者信息权的圆满状态。与此同时,法律需要明晰经营者信息的财产权保护的界限,防止绝对权保护引起的信息垄断,维护信息的自由传播。为此,信息的财产权保护应仅限于对数据和专有信息的支配。信息制作者的经营者信息权也受到强制许可、权利期限和个人信息权的合理限制,防止信息制作者滥用权利,以促进社会信息财富的最大化。

In the era of big data,operator＇s information has developed to be a kind of new property,which is independent from real and wisdom results. The law should grant the protection of operator＇s information,and build the legal right of operator＇s information. Essentially,operator＇s information right is an absolute right,whose holder is entitled to the claim of removing obstructions,eliminating dangers,recovering information and deleting information to maintain the complete state of the operator＇s information right. At the same time,it is necessary to clarify the boundary of the property protection of operator＇s information,in order to prohibit information monopoly caused by the protection of absolute right and also to maintain the freedom of information transmission. Therefore,the property protection of information should be limited to dominate the data and proprietary information,and the law should make necessary restrictions on the right,including imposing disposition obligation on the right,limiting the term of the right,and coordinating the relationship with operator＇s information right,in order to prevent information producer from abusing the operator＇s information right,and to maximize the wealth of information in society.
