论《制止核恐怖行为国际公约》与我国相关立法的协调

On the Coordination between the International Convention on the Suppression of Acts of Nuclear Terrorism and Relative Laws of PRC

核恐怖主义是当今国际和平与安全面临的最严重挑战之一。作为《制止核恐怖行为国际公约》的缔约国,我国在刑法、刑事诉讼法、国家安全法以及即将出台的反恐怖主义法等多个相关立法中不断将该公约的内容"国内化"。未来有必要在刑法中增设非法持有危险物质(或核材料)罪以及危害"核装置"的相关罪名,将核恐怖犯罪列入"国际犯罪"专章加以规定,取消运输、储存枪支、弹药、爆炸物、危险物质罪的死刑,以促进国内法与该公约的全面协调,进一步完善我国的核反恐立法。

Nuclear terrorism is one of the most serious challenges to the world peace and security.As the signatory country of the International Convention on the Suppression of Acts of Nuclear Terrorism,the domestication of the Convention is made by our criminal law,the criminal procedure law,the national security law and the upcoming anti-terrorism law.In order to further the complete coordination with the Convention and perfect our anti-nuclear terror legislation,it’s necessary to add the crime of illegal possession of dangerous substance（or nuclear materials）,to add relative crimes of endangeringnuclear device＂,to list nuclear terrorist crime ininternational crime＂and stipulate it with special chapter,to abolish the death penalty of the crimetrafficking,storage of firearms,ammunition,explosives,dangerous substances＂.
