我国大学章程法律属性与功能探析

大学进入"立宪时代",大学章程建设的实效性成为焦点,但当前大学章程功能定位的迷失,使重新审视大学章程的法律属性、功能等具有现实的必要性。作为联接国家法律法规和学校内部规范性文件的纽带,大学章程是法定性与自治性的统一,大学章程的功能有对象功能与体系功能之分,对象功能主要有保障功能、规范功能、协调功能和限制功能等,体系功能包括确认功能和创设功能。

With many universities entering the age of ＂constitution estsablishment＂,the effectiveness of the construction of the university statutes has become the focus. However,the functional localization of the university statutes is lost at present,which makes it necessary in reality that people should re-examine the legal attributes andfunction of the university statutes. As a conjunction of national laws and regulations and internal documents at school,the university statutes are the unification of legality as well as autonomy. The function of the university statutes can be divided into objective function and system function. The objective function consists of guaranteeing function,normalization function,coordinating function,restrictive function and so on. The system function includes confirm function and creation function.
