彝族的神判仪式及其现代启示研究——以案例为中心

A Study of the Ritural of Yi People's Divine Judgement and Its Modern Enlightenment:Taking Case as the Center

神灵裁判是彝族习惯法的一种,兼具仪式维度、宗教维度与法律维度,是彝族习惯法中值得深入探讨的话题。目前,学界对彝族神判往往放在整体习惯法研究中加以介绍,稍嫌泛泛之谈,缺乏对彝族神判的专门研究。因此,拟以一个1987年的神判案例为中心对彝族神判的神判仪式、社会效用和司法启示加以探讨。

Dive judgement as one part of Yi People’s unwirtten law,which the dimension of law,of religion and of ritural are included,is worth discussing when we study Yi People’s unwritten law.It’s obviously a pity that we don’t focus much on it,and the general way is to discuss it as a part of unwirtten law,it felt like vague and general in the contents.So I propose to discuss the ritural,the social function and the Judicial enlightenment of dive judgement in the center of one case in 1987.
