临床法学教育模式之理性思考——仿效临床医学教育模式 被引量:2

摘要 临床法学教育是效仿临床医学教育模式,将在法院、检察院、律师事务所等法律实务部门进行的司法实习称为临床法学教育。我国高等法学教育在经历重建、恢复、迅速发展三次大转型时期之后有了很大的发展。但是,进入21世纪以后,由于相关机构对高等法学教育缺乏长远规划、设立审批把关不严,导致现在的高等法学教育规模过于庞大,并逐步向"市场化"、"产业化"的方向发展。更令人忧虑的是,临床法学教育一直是我国高等法学教育中最为薄弱的教育环节。法学和医学看似是两个相差很远的专业,但根据二者的特点又能从中发现它们之间存在一些共性和联系。为了培养和造就一批合格的专门法律人才,实现依法治国的宏伟目标,教育主管部门应当仿效临床医学教育模式,对高等法学教育模式进行必要的调整和改革。 As an educational model, clinical law education follows the model of clinical medi- cion, and it is one of internship program conducted by High Courts, People's Procurator- ates, and law firms. Higher learning of law in China has made great progress after phases of reconstruction, restoration, and quick development. However, it has become excessive, "marketized" and "industrialized" due to lack of long-term planning, strict examination and approval. Even though law and medicine seem to be totally different subjects, there is still certain connection between them. To cultivate a group goal of ruling country by law, education authorities of eligible law should follow talents and the model realize the of clinical medical education to adjust and reform higher learning of law.
