基于不完全契约理论的大学章程利益相关者分析

The Analysis of University Charter Stakeholders Based on the Incomplete Contract Theory

从经济学的角度看,大学章程是一份不完全契约,它对政府、社会、教师等利益相关者的地位、权责进行了根本性规定。通过对国内外大学章程比较发现,国内大学章程存在地位不高、契约属性不强、利益相关者地位不平衡甚至相对缺失等不足。研制、修改国内大学章程,必须张扬章程作为大学宪章的特殊价值,遵守大学章程的不完全契约属性,谨慎保持利益相关者的平衡关系。

From an economic point of view, university charter is an incomplete contract. It has fundamental regulations about government, society and teachers＂ status and accountability. Though the contrast analysis of domestic existing university charters, especially the domestic and the abroad, found that domestic univer- sity charterg status is not high, the contract attribute is not strong, the position of stakeholders is not bal- anced and even relative lack. Developing and modifying the domestic university charter should make the special value of university charter known widely, abide by the university incomplete contract attribute, be careful to keep the balance among the stakeholders.
