刑事案件构成要素的反思与重构

The Reflection and Reconstruction of the Constituent Elements of Criminal Cases

作为侦查学基本理论问题,刑事案件的构成要素在整个侦查学理论中占据着重要的基础地位。现有侦查学理论中,无论是"五要素说""六要素说""七要素说"还是"立体构成要素说",都不够全面、不能够从构成要素上将刑事案件与其他事物有效区别出来。通过分析、研究明晰了刑事案件应当由主体、时间、空间、行为和变化等五大要素构成。

As the basic theory of the investigation, the constituent elements of criminal cases occupy an important position in the whole investigation. In the existing theory of criminal investigation, whether the theory of ＂five elements＂, ＂six elements＂, ＂seven elements＂ or ＂three-dimensional elements＂ and etc. are not comprehensive and can＇t effectively distinguish the criminal cases from the composition. The criminal cases should be defined by the five elements： the main body, time, space, behavior and change by redefining the concept of criminal cases.
