完善我国《反垄断法》宽大制度的研究——兼就《横向垄断协议案件宽大制度适用指南(征求意见稿)》提出几点建议

为了有效打击卡特尔行为,越来越多的国家和地区在反垄断法中引入宽大制度。我国宽大制度构建的过程中应当综合考量宽大申请者、宽大人数、宽大幅度以及刑事责任免除等因素,在增加制度适用的透明度和可预见性的同时,引入附加宽免制度鼓励不符合宽大条件的违法者对另一个与本案无直接联系的卡特尔案件进行告发以寻求宽大,为反垄断执法机构发现和追究其他卡特尔行为提供便利。从东方道德伦理角度上看,告发自己的"盟友"换取丰厚回报会严重影响宽大申请者在本行业的商誉,因此有必要对宽大申请者的身份信息采取保密措施,以免被外界识别而影响宽大政策功能的发挥。

For efficiently combating cartels, more and more jurisdictions introducing leniency policy in anti-monopoly law. In the process of constructing leniency programs,we should comprehensively consider the various factors, such as the qualification of leniency applicant, numbers and extent of leniency, exemption from criminal liability and so on. When improving of transparency and predictability of system application, the authorities should introduce leniency plus to encourage a cartelist, who is unable to secure complete immunity under the leniency programs, to cooperate with the anti-monopoly authorities, to facilitate discovery and investigation of other cartels. From the perspective of oriental ethics, an undertaking turns on allies for having good returns,which will seriously damage to its business reputation in the industry. Therefore it is necessary to keep identity information of leniency applicant secret, to avoid being identified and diminishing the function of the leniency policy.
