论我国反腐败国际追赃中腐败资产分享制度的构建

腐败资产分享可以有效促进反腐败合作,有利于腐败资产的返还和处置。腐败资产分享这一原则基本上已为国际社会所接受,《联合国反腐败公约》具有支持资产分享的倾向。美国、英国、加拿大和澳大利亚等国都建立了相对成熟的资产分享制度,签订了一系列协议。我国可以以个案合作成功案例为基础签订资产分享协议,建立腐败资产分享制度,设立腐败资产管理基金。

The sharing of corrupt assets can effectively promote the anti-corruption cooperation, which is conducive to the return of corrupt assets and disposal. The principle of sharing of corrupt assets has been accepted by the international community, ＂the United Nations Convention against Corruption＂ has a tendency to support asset sharing. The United States, Britain, Canada and Australia have established a relatively mature system of asset sharing, signed a series of agreements. Our country can sign the sharing agreement on the basis of the successful case cooperation, establish the system of asset sharing and corrupt assets management fund.
