摘要
被害人的诉讼主体地位、侦查行为侵权性的特点和律师法律服务职能的本质决定了侦查程序被害人获得律师帮助权具有正当性根椐。该权利应当包括提供法律咨询、阅卷权、在场权、调查取证权、代理申诉、控告和提供意见权六项具体权能。为了保障律师在侦查阶段为被害人提供有效法律帮助,还必须解决律师的数量、律师为被害人提供法律帮助有效性的检验标准和侦查机关侵犯律师帮助权的法律后果三个问题。
The lawsuit main body status of the victim, the characteristics of the detection behav- ior QinQuanXing and the nature of the legal service function determine it has legitimacy root for the fight of the victim to get help from a lawyer in investigation procedure. This fight should include six specific powers, they are provide legal consultation, reading, the presence of rights, the fight of in- vestigation, represent appeal and accusation, and the fight to advise. In order to ensure lawyers to provide effective legal aid to victims in the investigation phase, We must also address three problems including the number of lawyers, the effectiveness of the testing standard of lawyers providing legal help for the victim and the legal consequences of the investigation organ infringing the right to get help from a lawyer.
