摘要
通过分析我国档案数据库内容受著作权保护的法律基础,归纳不同类型档案数据库的著作权归属,总结出现有法律对档案数据库著作权保护的局限性及《著作权法》对档案数据库内容的"弱"保护问题:重结构保护轻内容和程序;对"独创性"的要求抽象,可操作性差;无独创性的档案数据库著作权保护缺失,进而提出完善档案数据库著作权保护的法理性建议。
By analyzing the legal basis of archival database protected by copyright ownership,this paper summarizes affiliations of archival database copyright from various types,generalizing the limitations of archival database copyright protected by current laws and the ＂weak＂ protection issues on the contents of archival database by Copyright Law： value the importance of the protection for structure,underestimate the content and procedures; the abstract requirement for the ＂originality＂ and the unsatisfied operability; shortage of copyright protection of unoriginal archival database and further comes up with rational suggestions on how to protect the archival database copyright much better.
