论我国人民调解制度的变迁——纠纷解决观、调解组织和调解功能

Concept of Dispute Resolution, Organization of Mediation and Function of Mediation:On the Vicissitudes of People's Mediation System in China

人民调解脱胎于我国传统调解,产生和发展于新民主主义时期。新中国成立后,人民调解得以正式制度化。任何制度的发展都是一个不断缔造的、动态的历史过程,在人民调解制度的发展变迁中,关于纠纷解决的观念、调解组织、调解功能等都出现了不同程度的断裂与延续。在人民调解制度的改革与完善中,要从历史出发,立足现实,培育和发展与现代社会相契合的调解制度。

The people’s mediation was originated from the traditional Chinese mediation,emerged and developed in the New-democracy Period of China. After the founding of new China, the people’s mediation was formally institutionalized. The formation of any system is a dynamic and growing historic process.During the developing and changing processes of people’s mediation system, there have been different degrees of shifts and continuity on the concept of dispute resolution,as well as on the mediation organization and function. In the reform and perfection of the people’s mediation system,the mediation system should conformi to the modern society to be cultivated and developed with a view to historical development and Chinese social realities.
