政府购买体育公共服务法律缺失与对策研究

Legal absence in government procurement of sports public service and countermeasures

政府购买体育公共服务的有效实施依赖于法律的保障,完善的法律体系是规避政府购买体育公共服务风险的最佳方式。采用文献资料研究等方法对现阶段我国政府购买体育公共服务法律问题进行探讨,研究认为:通过政府购买,有效解决了政府能力有限的问题,体育公共服务产品质量得到提高,体育公共产品更加丰富、覆盖面更广。现阶段政府购买体育公共服务中存在的法律问题包括:政府购买体育公共服务的相关法律法规缺失,体育公共服务政府购买的法律程序还不完善,政府购买体育公共服务的监督体系和机制还不健全。目前还需在《政府采购法》的框架之下,建立政府购买体育公共服务地方法规为补充的体系,健全政府购买体育公共服务的法律程序,完善多元化的政府购买体育公共服务监督体制,坚持依法行政等。

The effective implementation of government to buy sports public service depends on the guarantee of law,so to perfect the legal system is the best way to avoid the risk of the government procurement of sports public services.Through the mining of literature materials on Chinese govern-ment to buy sports public service,we discuss the legal problems within and find that government procurement effectively solved the problem of government limited ability,sports public service prod-uct quality was improved,and the varieties of the products were richer.At present,the legal prob-lems in the government procurement of sports public services include that the relevant laws and regu-lations are absent,some procurement legal procedure are imperfect,and the supervision of the gov-ernment procurement system and mechanism is not sound.It is to be under the framework of the gov-ernment procurement law,establish local laws and regulations to supplement the government pro-curement legal system,perfect the government procurement law process and supervision system,and adhere to administration according to law.
