我国公民集体表达自由的法理反思与路径完善

Legal Reflection and Path Improvement of Chinese Citizens' Freedom of Collective Expression

集体表达自由是公民通过集会、游行、示威等集体形式表达意愿的自由。虽然集体表达自由如未能规范行使,可能对社会造成较大的破坏,但集体表达自由仍然有利益表达、民主参与、监督权力、缓冲矛盾的巨大价值。当前,集体表达自由在我国不管是立法还是实践都存在一定的不足,致使公民集体表达自由实现不畅,影响了公民诉求的表达以及社会矛盾的缓解。下一步应从转变观念、完善立法等方面完善我国公民的集体表达自由。

Freedom of collective expression, which grants the citizens the freedom to express their will through assembly and demonstration, may cause considerable damage to the society if performed incorrectly. But it still has a great value in interest articulation, democratic participation, power supervision and buffering contradiction. Currently, freedom of collective expression is imperfect both in legislation and practice in China, which hinders citizens’ freedom of collective expression and also affects citizens’ expression of their appeals and ease of social contradictions. It is suggested to perfect the citizens’ right to freedom of collective expression in transforming idea and improving legislation.
