论我国社区矫正之完善

On the Perfection of Community Correction in China

社区矫正是人类文明不断进化发展的必然结果,也是人类社会进步的重要标志。刑罚执行理念也由原始的同态复仇向报应主义再向行刑社会化转变。经过十多年的发展,我国社区矫正制度取得了一定成就,但还存在着认识观念未得到根本性转变、适用范围窄、存在异化风险等缺陷。针对现存缺陷,本文立足我国国情并参考域外相关实践从观念改变、完善立法、加强监督等方面提出了可行性建议。

Community colrecfion is the inevitable result of the evolution of human civilization development, is also an important symbol of human society progress. Penalty execution concept is from the original homomorphism revenge to the socialization transformation. After ten years of development, community correction system in our country has obtained certain achievements, but there are some shortcomings in community correction, such as unchanged thought, strongly policy, narrow scope of application. In view of the existing defects, this paper puts forward feasible suggestions according to the foreign experience.
