审讯中侦查人员与犯罪嫌疑人的合作——基于合作博弈的认识

On Cooperation between Investigators and Criminal Suspects in Interrogation——Based on Cognition of Cooperative Game

尽管对抗是审讯的基本属性,但审讯中存在着侦查人员与犯罪嫌疑人合作的可能。为促成侦查人员与犯罪嫌疑人的审讯合作,侦查人员可以依照拟定合理的合作方案、引向重复博弈、让犯罪嫌疑人认识到利益的取得是可信的、做出必要的退让和兑现赏罚的基本思路,采取制造信息不对称、拆穿谎言、运用"纳什均衡"点、用好供述原理、用好法律、利用道德情感约束以及施用其他技巧等具体做法,最终达到审讯的有效进行。

Although confrontation is the basic property of interrogation, there is still the possibility of cooperation between investigators and criminal suspects in interrogations. In order to promote the cooperation, investigators shall adopt the specific methods such as asymmetric information, lies nailing, ＂ Nash equilibrium＂, theory of confession, reasonable use of laws, moral emotion constraints, and use of other techniques to achieve the effective implementation of interrogation, according to the basic thoughts including formulation of rational cooperative plan, repeated games , necessary concession, rewards and punishments fulfillment, and criminal suspects may realize that the access to interests is credible.
