摘要
随着社会经济的发展,妇女劳动者的思想文化和认识程度不断加深,有关妇女劳动权立法方面的问题需要进行反思。本文主要从立法内容和立法理念两个方面去分析、解决问题,除了立法理念外,立法内容方面则重点分析妇女劳动者在工作中遇到的性骚扰和就业性别歧视的问题,通过明确判定标准和加大惩罚力度来解决立法之后遇到的困难,以便能够更好的维护妇女劳动者的权益,促进我国现代法治社会的发展。
With social and economic development, woman workers have a higher education level and more consciousness of protecting their legal rights. Therefore, a reflection on legislation on labor rights of women is highly needed. The paper mainly analyzes and solves the problems from the perspective of legislative content and principle. Besides legal principle, this paper studies the legislative content by focusing on sexual harassment and sexual discrimination in employment. Such measures are proposed to safeguard legal rights of women to work and advancement of law ruling in China as more specific criteria for conviction and more severe penalties.
