摘要
随着市场经济的发展及以《劳动法》《劳动合同法》为代表的劳动法律体系的日趋成熟,就业协议书由于缺乏明确的立法规定,其法律定位、责任承担在学理和实务中引起了很大争议,要妥善解决因就业协议引起的纠纷,必须明确就业协议书本身的法律性质。
With the development of marketing economy,as well as the maturity of "Labor Law"and "Labor Contract Law",the inadequacy of employment agreement is more obvious. There are controversies in terms of legal position and responsibility,theoretically and practically speaking. To cope with the controversies requires to clarify the legal nature of the employment agreement.
