中国中药专利自实施影响因素研究

Research on Influencing factors of China's TCM Patent Self- implementation

[目的/意义]以具有鲜明中国特色的中药专利为研究样本,探究其自实施的影响因素,以期对中药专利的研发及产业化有所裨益。[方法/过程]通过将多个数据库整合,获得中国制药企业中药授权发明专利的自实施数据,以其作为研究样本;根据中外文献研究,构建企业专利自实施影响因素模型;通过二元Logistic回归以及Probit回归,挖掘各影响因素对制药企业中药专利自实施的影响力。[结果/结论]模型回归结果显示,技术潜在需求、企业生产能力和技术覆盖范围等影响因素与专利自实施正相关;技术市场竞争程度与专利自实施成负相关;企业年龄、技术实施的互补资产、技术人员投入力度与专利自实施相关性不显著;技术科学性和技术保护复杂度对专利自实施的影响较为复杂。我国制药企业应根据企业外部、企业内部及专利三方面因素进行专利布局,以提升企业中药专利自实施率。

[Purpose / Sgnificance] TCM patent with distinct Chinese characteristics as samples,this study explore the factors that affect the self- implementation,and expect to benefit development and industrialization of TCM patent. [Method / Process]By integrating multiple databases,this study obtain TCM patent self- implementation data of Chinese pharmaceutical companies as a research sample; According to domestic and foreign literature,building patent self- implementation＇s influencing factors model and using Logistic regression and probit regression,finally excavate various factors＇ influence of TCM patent self- implementation.[Results / Conclusion]Regression results show that technical potential demand,production capacity and technology coverage have a positive correlation with patent self- implementation; Technology market competition is negatively correlated with patent self- implementation; Firm age,complementary assets of technical implementation and technical staff investment which don ＇t have a significant correlation with patent self- implementation.Technical scientific nature and the complexity of the technical protection have a more complex effect on patent self- implementation. China＇s pharmaceutical enterprises should lay out based on three factors about outside and inside of the enterprise and patent。
