While promoting standardization, more and more patent technologies have been incorporated into technological standards. The problem is that some patentees carry out patent hijacking activities, taking advantage of technological standardization. These activities include demanding exceedingly high royalty feed from technological standard users, refusal of license, posing treat with injunctions, etc. How to defi ne the activities, the characteristics, and how to borrow from foreign legal experiences to enrich China＇s laws and regulations in this regard call for serious studies.
