摘要
为进一步规范和完善农村集体经营性建设用地入市制度,采用文献、案例、类比分析法,探究农村集体经营性建设用地入市的动因.研究结果表明,农村集体经营性建设用地入市是在"燃烧物质"(工业化和城镇化快速发展、土地资源优化配置)、"助燃剂"(农地所有权归属不清、节约集约利用土地、土地利用比较利益差距大)、"点火温度"(土地产权制度改革、建立城乡统一建设用地市场)共同驱动因子下作用的结果 .由此提出应该重点解决农村集体经营性建设用地入市问题的以下建议:完善相关法律法规、产权清晰、落实确权登记、统计核实经营性建设用地数量和构建交易市场并加强管理.
The purpose of the paper is to study the market of rural collective operational construction lands,to analyze the main factors of entering the market of rural collective operational construction lands and to offer basic theoretical principles for regulation system about entering the market of rural collective operational construction lands. The methods are as follows: documents analysis,cases analysis and analogy analysis. The results showed that the entering market of rural collective operational construction lands resulted from combustible substance,( The rapid development of the industrialization and the Urbanization,the optimization in allocation of resources) combustion improver,( unclear ownership of lands,conservation in using lands,the gap of benefits in using land) ignition temperature,( the reform of property policies,the establishment of market between city and countryside) and was influenced by the interaction of the three elements. We concluded that,in the entering market of rural collective operational construction,improvement should be made in legislation,clear ownership of lands,implementation in registration,statistics and verifier in number of operational construction lands and enhanced management.
