"贸易促进权"体现了美国总统与国会之间的宪法权力关系,是理解美国贸易政策的形成与演变的一把钥匙。过去几年中,围绕"贸易促进权",美国国内各种力量,包括行政部门、国会和各种利益集团等,就行政部门与立法部门之间的宪法权力关系、自由贸易协定谈判的透明度、汇率操纵、劳工标准、环境保护、公平竞争、就业与福利、全球贸易规则制定及美国的全球领导地位等议题展开了激烈的争论。这些争论影响了2015年"贸易促进权"法案的内容,也影响了"跨太平洋伙伴关系协定"和"跨大西洋贸易与投资伙伴关系协定"等贸易协定的谈判进程,并对这些协定未来的批约过程产生影响。
The Trade Promotion Authority( TPA) shows the relationship of constitutional powers between the US President and the Congress and is a key to understanding the making and evolvement of US trade policy. In the last few years,debates on TPA,including specific issues,such as the constitutional powers of the President and the Congress,transparency in free trade agreement negotiations,currency manipulations,labor standards,environmental protection,fair competition,employment and welfare,global trade rules,and US global leadership,went on heatedly among the administration,and the Congress,as well as many related interest groups. These debates have exerted great influence on the Bipartisan Congressional Trade Priorities and Accountability Act of 2015( especially on its content and passage in the Congress) and the negotiation procedures of the Trans-Pacific Partnership( TPP) and the Transatlantic Trade and Investment Partnership( TTIP),and will also influence their coming approval procedures in the Congress. By clarifying these debates we can see better the future directions of U. S. trade policy.
