酌定不起诉和附条件不起诉关系的研究与协调

Study on the Relationship and Coordination with Discretionary Non-prosecution and the Comparative Snalysis of Conditional-prosecution

2012年《刑事诉讼法》第五编第一章特别程序中增加了一种新的不起诉方式:附条件不起诉,丰富和完善了我国的不起诉体系。但是在司法实践中,其与同属裁量不起诉类型的酌定不起诉产生了混淆不清的关系,归根结底是因为两种不起诉本身固有的立法缺陷,造成适用范围交叉重合的困境,检察机关在作出不起诉决定时难以抉择。为此,应把重心放在两种不起诉的改革上,对症下药方能药到病除。

the Part Five of the First Chapter in Criminal procedure law in 2012 adds a new way of non- prosecution system： comparative analysis of conditional- prosecution,which enriches and perfects our country＇s non- prosecution system. But in judicial practice,it has a confusion of the relation with discretionary non- prosecution which belong to the same type of prosecutorial discretion,and in the end it comes down to intrinsic defects in legislative,which causes the dilemma of scope and application,making a hard choice for procurator organs. Therefore,we should focus on the reform of the two kinds of institutions; seek appropriate remedy to solve the problem.
