中国民间法的当代价值及其应用路径

On the Contemporary Value of Folk Law and Its Application

伴随着全球范围内法社会学思潮的兴起,民间法业已成为学界所关注的热点话题。在当今中国,它主要通过少数民族习惯法、乡村习惯法、村规民约、商事惯例与行业规定等形式予以呈现。与国家法相比,民间法具有其特有的规范价值、公共性重构价值、经济价值。在构建现代法治国家的语境之下,民间法基于其当代价值仍然可以扮演重要角色。具体而言,在实现社会主义法治的进程中,应从"立法主导主义"走向"法律多元主义",理清民间法与国家法各自的作用领域与作用范畴;国家法通过自治条例或单行条例的方式对民间法中的合理内容予以借鉴,方有利于实现国家法与民间法之间的良性互动,从而达成社会和谐之目的。

With the worldwide development of sociology,folk law has increasingly become a hot topic in academic circle. As a complicated concept,folk law contains customary laws of ethnics,village regulations,family rules,commercial usages and industry standards. Compared with national law,folk law has its own normative values,public reconstruction values and economic values. Thus,under the background of establishing a modern country guided by the rule of law,folk law still plays an important role by its contemporary values. Specifically,in this process,we have to turn from legislative dominant to legal pluralism,with the purpose of clarifying the scope of folk and national laws. Meanwhile,national law can be enlightened by the reasonable contents of folk law by virtue of autonomous decrees and special decrees,which is beneficial to achieve the positive interaction between the two laws and thereby establish a harmonious society.
