论微博转发行为受著作权法保护的依据——兼论合理使用制度的完善

The Basis of Microblog Forwarding Behavior Protected by Copyright Law

著作权的扩张压缩了合理使用的空间和范围,以微博转发为代表的传播与分享信息的行为难以在著作权法,尤其是合理使用制度中找到法律支撑。不论是基于微博的本质属性和社会功能,还是基于言论自由和著作权的关系以及合理使用制度的立法动因及优越性,一般的微博转发行为都应当适用合理使用制度。应在《著作权法》中增设兜底条款,在《著作权法实施条例》中作更加细致的规定,并借鉴美国立法模式,完善判断标准。

Copyright expansion compress the space and scope of fair use. The behavior which communicates and shares information on the behalf of microblog transpond is difficult to find the legal support in the current Copyright Law, especially in the reasonable system. Whether it is based on the essential attribute and the social function of microblog, or based on the relation between the freedom of speech and copyright and fair use system of legislative reason and superiority, microblog forwarding behavior should be generally applicable system of rational use. We Should add miscellaneous provisions in the Copyright Law, stipulate more detailed provisions in the ＂Copyright Law Implementation Regulations, take example by the US legislative mode, improve the judgment standard.
