依法治国作为一种中国式的法治与文化,是从中国固有的文化传统中生长起来的。具体地说,依法治国是先秦法家的以法治国吸纳了西方传来的法治文化的产物。从文化传承的角度看,从先秦法家的以法治国到当代中国的依法治国,是一条持续不断的文化主流。从文化交往的角度看,西方法治文化是19世纪末期汇入中国文化主流的。相对于西方汇入的法治文化而言,先秦法家的以法治国构成了依法治国的文化源头。较之于西方传来的法治文化,先秦法家的以法治国更有力地塑造了当代中国的法治形态,那就是当代中国的依法治国。

From the perspective of cultural heritage,from the rule byof law Xian- Qin Legalists to the contemporary China＇s rule by law is a constant of the mainstream culture. From the perspective of cultural communication,the western rule of law culture import to the mainstream of Chinese culture in the late nineteenth Century. Compared with the western legal culture,Xian- Qin Legalists constitute the cultural source of the rule by law of the contemporary China. Compared with western culture of the rule of law,rule by law of the Xian- Qin legalist school more force to shapethe form of the rule of law in Chinese contemporary.
