缺陷药品侵权责任研究

Studying on tort liability of defective drugs

目的:明确药品缺陷的分类,分别探讨各类药品缺陷所致损害的侵权责任。方法:本文从法律渊源出发,采用文献研究、案例研究、法学理论解释和逻辑推理等方法进行评述。结论:根据药品缺陷所产生的阶段,将药品缺陷分为研究缺陷、制造缺陷、警示缺陷、储存缺陷、使用缺陷,其侵权责任的承担也分别归属于不同阶段造成缺陷的责任主体。

Objective：To definite the classification of drug defect, and respectively discuss the tort liability of all kinds of drug defects caused damage. Method：In this paper, the use of literature research, case studies, legal theory interpretation and logical reasoning and other methods are used to review starting from legal sources. Result：According to the stage drug defects generated, the defect are divided into studying defects, manufacturing defects, warning defects, storage defects, using defects. And the tort liability also belongs to the subject of liability who cause the defects in different stages.
