“区域法治先行”概念基础与实践径路的再检讨

Revisiting the Conceptual Basis and Practical Path of “Heading the Implementation of Regional Rule of Law”

"区域法治先行"问题对于当代中国法治建设整体而言,体现在如何更好协调在法治建设过程中中央与地方关系的方面,也是实现国家治理体系和治理能力现代化不可忽视的重要方面。"区域法治"概念得到重新重视、其内涵得到进一步丰富,是在"法治中国"建设的战略目标下理论探索的最新体现。不过,"区域法治先行"概念的成立必须建立在一定的理论和现实历史条件的基础上,而其实际的试验过程必须要循着适当的路径前行,否则,理论界的某些担忧就会带来现实的麻烦。随着改革开放的全面推进和中国经济社会的进一步发展,在先行地区进行的法治实践必然会通过跨区域合作的形式,将其经验教训予以传播,从而对国家法治发展进程产生积极影响。

In terms of the overall objective of constructing rule of law in contemporary China,the issue of ＂heading the implementation of regional rule of law＂ lies in how to coordinate the central government and the local governments in the process of building rule of law. Its significance should not be ignored for the modernization of China＇s governance system and capacity. The concept of ＂regional rule of law＂ has gained renewed attention and further development; it is the latest result of theoretical exploration in achieving the strategic target of ＂rule of law in China＂. However, the concept of ＂heading the implementation of regional rule of law＂ has to be based on certain theoretical and realistic historical conditions and its actual implementation follow an appropriate path. Otherwise, the worries expressed by some theorists may turn into real troubles. With the comprehensive advancement of reform and opening up and the further development of China＇s economy and society, the experience and lessons we can draw through the practice of rule of law in the pilot test areas will surely be spread all over the country through cross-regional cooperation and consequently produce positive effect on the development of rule of law in China.
