摘要
上海、广东、天津和福建自由贸易试验区(以下简称"自贸试验区")的管理行为的国际法效果归于中国政府,因此其制度创新需建立在国际合法性的基础之上。就发达国家关注的贸易政策合规、知识产权保护和"社会倾销"等涉及贸易公平的问题,四大自贸试验区需要在内化实施《补贴与反补贴协定》《与贸易有关的投资措施协定》及《与贸易有关的知识产权协定》方面充当表率,在强化知识产权的边境保护发挥引领作用。自贸试验区有必要在加强劳动标准的实施方面有所创新,以消除国际社会对中国所谓的"社会倾销"的顾虑。同时,基于大陆和台湾同为WTO成员的事实,福建自贸试验区推进两岸深度合作的相关立法作为国内安排,需注意不违反WTO的非歧视规则,避开贸易方面的特别优惠。
The legal effect of trade measures in China Pilot Free Trade Zones of Shanghai,Guangdong,Tianjin and Fujian attribute to central government of China. Considering the typical concerns of developed countries,i. e. concerns on legality of trade policy,intellectual property protection, 'social dumping',these pilot zones shall set good examples of compliance of typical international rules of fair trade,i. e.,Agreement on Subsidies and Countervailing Measures,Agreement on Trade-Related Investment Measures,Agreement on Trade-Related Aspects of Intellectual Property Rights. It is necessary for these pilot zones to take a lead in higher level of intellectual property protection including border measures. And it is also necessary for these pilot zones to make innovation on more effective implementation of labor standard. Based on the fact that Taiwan is also a member of WTO,Fujian Pilot Free Trade Zone shall ensure international legitimacy of relevant Cross-strait cooperation arrangements; the relevant special incentive shall not focus on trade,but on investment.
