论“互联网+”时代我国的电子送达制度

On Electronic Service System of Our Country in the“Internet Plus”Era

随着网络及通讯技术的飞速发展,电子送达凭借高效、便捷的特点越发受到青睐,在我国的域内送达和域外送达中均得到适用。但由于技术的无限性、不稳定性与法律的有限性、稳定性之间的对立,我国的电子送达制度存在着法律规制模糊不清,域内、域外送达交叉混乱等问题,对职权主义诉讼模式下送达主体单一性理论造成冲击,域外电子送达制度的发展更是受到司法主权理论的阻碍。在"互联网+"的时代背景下,我国应该转变理论认识、注重技术创新、构建相关制度来完善我国的域外电子送达制度。

With the rapid development of network and communication technology,because of the characteristics of convenient and efficient increasingly favored,and be applied in both region and abroad service.But due to the opposition of unlimited and instability of technology and limited and stability,China＇s electronic service system exists lists of problems such as the vague of legal regulations,the chaos between service of domain and abroad.The authority doctrine litigant mode served single subject theory and the judicial sovereignty theory also have negative impact on it.Under the background of ＂Internet Plus＂era,China should change theory understanding,pay attention to technological innovation,build related system construction to improve our foreign electronic service system to successfully overcome the complexity and difficulty of the service of abroad successfully.
