上海市2011-2015年卫生计生行政复议和行政诉讼案件调查分析

Investigation and analysis of health administrative reconsideration and administrative litigation cases in Shanghai city in recent five years

行政复议和行政诉讼是将解决群众诉求纳入规范化、法制化轨道的重要制度。做好行政复议和行政诉讼工作对推动法治政府建设、有效化解行政争议和社会矛盾、构建法治政府具有重要作用。本文通过调查2011-2015年间上海市卫生计生委的行政复议和行政诉讼案例,总结了上海卫生计生行政复议和行政诉讼案件发生的基本特点,分析了主要原因,并提出了相应的对策和改进建议。

Administrative reconsideration and administrative litigation is an important system to put solving the mass appeal on the standardized and legalized path.Promoting the administrative reconsideration and administrative litigation play an important role in enhancing law-based government construction,effectively resolving administrative dispute and social contradictions.Based on the investigation of administrative reconsideration and administrative petition cases in Shanghai Health and Family Planning Commission from 2011 to 2015,this paper summarized the basic characteristics of administrative reconsideration and administrative litigation cases,analyze the main reason,and put forward the corresponding countermeasures and suggestions for improvement.
