摘要
承包地协议流转是农民实现土地财产权利的重要途径,但实践中存在流转土地的用途被私自变更、发包方同意形式化、约定流转期限超出法定承包期、政府部门的监管缺失等问题。为了既有效保护农民土地权利,又规范推进城乡统筹发展,我国应加快农村土地承包经营权的确权颁证工作,完善发包方同意的制度设计,由政府部门制定和发布统一文本的承包地流转合同,加强土地用途管制,及时纠正违法行为。
The circulation of rural contracted land agreement is an important way of promoting the farmers' land property right. But there are lots of problems in practice, such as the land use is changed without permission, the project owner accept the formalization, the circulation deadline is beyond the statutory contract period, lack of the government supervision. In order to effectively protect farm- ers' land rights and promote the development of urban and rural areas as a whole, China should speed up to promote the land right cer- tification, perfect the system design approved by the project owner, formulate and publish unified text of the circulation contract of the contracted land by government, to strengthen the land use regulation and timely correct illegal behavior.
