论社区矫正对象的拓展及程序完善

On Extension and Improvement of Community-Based Correction Objects

我国社区矫正工作,由于历史积淀还不够深厚,存在矫正对象一成不变以及实施程序不够完善等问题。可以把半监禁、未成年人以及刑满释放人员纳入社区矫正对象范畴,作为行刑方式、预防犯罪、控制犯罪综合治理手段的社区矫正适用对象的拓展。同时通过构建调查评估程序、矫正对象裁量中的听证程序、权利保护与救济程序和其他程序来建立健全完善的社区矫正程序。

Aiming at such problems as invariable correction objects and incomplete implementation procedures in community-based correction work,those part-time imprisoned violators,under-age violators and emancipists can be brought into community-based correction objects as the comprehensive treatment means of extension of community suitable correction objects,and at the same time,we can establish and improve community-based correction procedure by constructing investigation and evaluation procedure,hearing procedure in the discretion of correction objects,rights protection and remedy procedure and other procedures.
