大学治理法治化的逻辑及内外发展路径探究

The Logic and the Internal- and- External Development Path of University Legislative Governance

大学治理法治化是当前国家、高校与社会关注的一个重大热点问题,关系着大学能否通过制度协调内外部高效运行。从逻辑向度和逻辑背景看,大学实现治理的法治化是发展的必然路径。纵观当前大学治理法治化建设,面临政府在办学管理上的权力本位观的外部困境和大学法治功能处于异化状态的内部困境,追根溯源,在于治理理念和法治理念不强所致。要提升大学治理法治化的能力,依赖两条发展路径:一是高校外部关系路径,包括法律法规的修订与完善、外部治理去行政化、确立大学的公法人地位和优化权力、责任的配置;二是高校内部治理路径,包括树立治理法治化理念、依法制定大学章程、平衡行政权力与学术权力的关系、加强程序性意识以及探索多元校内治理体系。

As an important key issue universities,government and society focus on currently,the legislative governance of universities is related to the efficient implementation of the internal and external development. From the perspective of logical dimension and background,realization of the legislative governance is the necessary path universities. Because of the lack of governance and legislation,current construction of university legislative governance is faced with two difficult problems,including the external and internal predicament. So in order to improve the rights- based managing mode for education,the related laws must be revised and the public corporation of universities must be established with the balance between authority and duty politically. The internal university governance path is also very important. In order to protect the legal function from dissimilation,it is useful to set up the idea of legislative governance,formulate constitution,make the balanced relationship between administrative rights and academic rights,strengthen ideas of procedure,and explore system of multi- governance of schools.
