摘要
由于社会经济发展,各种就业形式层出不穷,大学生走出校门从事兼职工作成为常态。但是,随之而来衍生出许多问题:由于兼职大学生的特殊身份,现行劳动法律法规并未将其纳入保护范围之内,于是经常出现用人单位随意克扣工资、无故延长工作时间、骗取押金等侵害大学生权益的事件。调查分析大学生的兼职现状,认为应从如下几个方面探究兼职大学生劳动权益保障的法律路径:提高大学生自身的法律意识和安全意识,完善国家现行劳动法律法规,加强政府部门监管,规范高校管理和服务,强化企业社会责任等。
With the social and economic development,various forms of employment are very common.College students out of the school to engage in part-time work become the norm.However,it comes with a lot of problems:because of the special identity,part-time college students are not protected by present labor laws and regulations incidents arise such as arbitrary deducting wages and lengthening working hours,and diddling deposit,which violates the college students' rights and interests.After the investigation and analysis of the current situation of college students' part time jobs,this paper put forward a complete and effective part-time labor rights protection system of college students:promoting the legal consciousness of college students themselves,improving current national laws and regulations,strengthening the supervision of government departments,standardizing management and service of colleges and universities and strengthening corporate social responsibility.
