关于调整检察机关职务犯罪案件办案组织形式的思考——以正在进行的司法改革为切入点

On the Organization Adjustment of Handling Duty Related Crime Casesin Procuratorates: Based on the Ongoing Judicial Reform

以员额制为核心的司法改革正在如火如荼地进行。检察官数量的减少将深刻影响现行检察机关职务犯罪案件办案组织形式。现行的多位检察官共同办案、团队合作的办案组织形式应当调整为由独任检察官、检察官助理、司法警察组成团队,并由检察官指挥侦查、检察官助理协助检察官指挥侦查、司法警察具体执行侦查的办案组织形式。

Judicial reform with member limit system at its core is prevailing now. The reduction in the number of prosecutors will affect the organization of handling duty related crime cases in procuratorates. The present organizational form that several prosecutors work in a team shall be adjusted to the new one in which a sole-prosecutor,a procuratorial assistant and a judicial police constitute a team with the sole-prosecutor leading the investigation,the procuratorial assistant assisting the sole-prosecutor＇s job and the judicial police executing the investigation.
