死刑复核程序的缺陷与完善

在众多的刑罚之中,死刑是最为严厉的。当今社会,经济在不断发展,人类的素质以及文明程度也在不断提高。因此在很多国家之中,死刑已经被取消了。即便是在那些依旧使用死刑的国家之中,该刑罚的应用范围也正在呈现逐渐缩小的趋势。毫无疑问,死刑是对于人的生命的剥脱,因此必须要对其严格控制。从目前使用死刑刑罚的国家来看,他们基本上是使用了程度不同的救济程序,以此来对死刑的适用来进行严格限制。在我国,死刑的存在是有其必要性的。那么,死刑复核程序,是具有中国特色的一种救济程序,无论是对于罪犯的保护还是对于死刑的限制全部发挥了其重要作用。当然,现行的死刑复核程序在使用的过程中依然存在一定的问题以及弊端,如果对此忽略不予以重视,那么不仅不能匡扶正义,而且也会使得死刑错判误判率增高的可能性加大。所以,对这些问题在研究的基础上必须要进行彻底解决,纠正所存在的缺陷,无论是在理论方面还是在实践方面意义都非常重大。

In today＇s society,the economy is developing continuously,and the quality of human being and the degree of civilization are constantly improving. So in many countries,the death penalty has been removed. Even in those countries where the death penalty is still used,the scope of application of the criminal law is also showing a gradual narrowing trend. There is no doubt that the death penalty is the life of the people,so it must be strictly controlled. From the current state of the death penalty criminal law,they basically use a different degree of relief procedures,in order to strictly limit the application of the death penalty. In our country,the existence of death penalty criminal law has its necessity. So,the death penalty review procedure is a kind of relief procedure with Chinese characteristics,whether it is for the protection of personnel or the limit of the death penalty all play an important role. Of course,the current death penalty review procedure in the use of the process still exist some problems and disadvantages,if this neglect it does not pay attention,then not only can not Kuangfu justice,but also makes the death penalty misclassification error rate increased to increase the possibility. Therefore,on the basis of the study of these issues must be thoroughly resolved,to correct the defects,whether in theory or in practice,is very important.
